A client buying an established business was being granted a new lease. The make-good clause required them to strip the premises back to bare bones — removing every fixture and fitting ever installed, not just those they were acquiring.
We negotiated this back to a fairer outcome: the client only needed to remove the items they were purchasing with the business — saving significant cost and stress down the track.
Struggling Tenant – Managed Exit Strategy
A client was struggling to sell her business, which wasn’t turning a profit, and was falling behind on rent. We negotiated an arrangement allowing her to pay rent in arrears while catching up, then surrender the lease and secure the release of a personal guarantee — with make-good obligations delayed until a new tenant was found. This kept open the possibility of minimising liability if the new tenant took on the fitout.
